DEFINITIONS

‘Benefits’are the products, services and benefits available to Members through the link with PROSPEROstore.
‘The Company’means Investment Analysis Limited and any subsidiaries.
‘Member’means a person who has paid in full the current membership fee entitling him or her to access the Website.
‘Membership’means the entitlement to access the Website and the use of the information on the Website for the duration of their Membership, or for such other period of time as determined by the Company.
‘Investing in the Best’is the stockmarket analysis website which is owned by IA and is available online through the Website.
’Investment Analysis’('IA') is Investment Analysis Limited, company registered number 02346821.
‘Renewal Date’means the date on which a Membership renewal commences.
‘PROSPEROstore’is the benefits site available via a link on the website which Members are entitled to use and purchase any products or services from and which is owned by PROSPEROstore Limited.
‘Services’means the investment research analysis and information provided to Members.
’Subscriber’has the same meaning and carries the same benefits as a Member.
‘Supplier’means a company or organisation supplying Benefits and Services to a Member on a third-party basis through PROSPEROstore.
‘Terms’means the Terms and Conditions described in this document including all definitions. Terms relate to www.investinginthebest.com and to associated and related websites, and to Services provided by the Company and its Suppliers to Members.
‘Website’and 'Websites' mean www.investinginthebest.com and all internet pages accessible within those Websites.
’We/us/our’means www.investinginthebest.com and/or Investment Analysis Limited.
‘You/your’means (as appropriate), the Member(s) accessing the Site or taking advantage of the Services.

TERMS AND CONDITIONS

General
As a Member, you agree to abide by the Terms. The Terms will apply each time you access the Website. The Terms may be amended from time to time if necessary and it is your responsibility to bring the Terms to the attention of anyone who may, through you, view material on the Website.

If you do not wish to be bound by the Terms, do not proceed to use the Website. If you have any questions relating to the Terms please contact us.

Access to the Website
You may access the Website if you purchase a Membership at the prevailing rate and become a Member. You will be given a username and password enabling you to log on. A person must be 18 years of age or over to become a Member and to access the Website.

Membership
When registering as a Member, you must provide us with complete and accurate registration information and it is your responsibility to inform us of any changes to that information (including in particular your email address) through the currency of the Membership, by emailing us at info@investinginthebest.com. If you do not provide accurate and complete registration information you may not be able to access the Website and we may not be able to provide you with the Services.

The right to access the Website is granted by the Company to one specific individual only (the Member). The Member is responsible for ensuring that no one other than the Member uses the Membership. The Company does not permit any other person to share the Member’s user name and password, neither does it permit access to the Website through a single username and password being made available to multiple users on a network. If you believe your login details are being used by an unauthorised person or in an unauthorised manner, please contact us immediately.

If we have reasonable grounds for believing that multiple users are sharing a Member’s single name and password, whether through a network or not, we reserve the right to cancel the relevant Membership immediately. If an unauthorised user attempts to purchase goods or services through the Website, we reserve the right to cancel any such purchase transaction immediately with the result that the unauthorised purchaser may forfeit any deposit or payment that has been made to a Supplier, prior to cancellation of the transaction.

Membership Fees, Cancellations and Renewals
The Membership fee is payable in advance and the current fee is shown on the online Renewal/Subscription payment page. The Membership fee is non-refundable except at the discretion of the Company and any such refund would be on a pro-rata basis. We reserve the right to cancel or suspend Memberships for any reason. In such an event, the balance of the Membership fee would be refunded on a prorata basis.

Investing
Investing in the Best is the title of the research and analysis published on this website. Research is published on the Website at intervals during the year.

Directors, representatives and employees of IA or related companies may have ownership interests in the companies featured in Investing in the Best. The Company makes every effort to ensure that all facts and figures are correct and that verdicts as to whether companies are overvalued, fairly valued or undervalued by the stockmarket are based on adequate research and analysis. However, no legal responsibility can be accepted for any errors, omissions or inaccuracies. Opinions, interpretations and conclusions are those of the Company. The stockmarket price and economic value of investments can go down as well as up. When you sell equity investments, you may not receive back the original amount invested. Past performance is not a guide or a guarantee of future returns.

The Company is not authorised to provide specific investment advice nor to deal in nor to arrange deals in investments under Schedule 2, Part 1 of the Financial Services and Markets Act, 2000 nor is it permitted to communicate an invitation or inducement to engage in investment activity under Part 2, Section 21 of the Act.

Applicable Law and Jurisdiction
The Terms of your Membership are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.

Data Collection and Privacy Policy
The Company will use the information provided by you in the course of processing your Membership for the purpose of fulfilling your Membership. Warners Group Publications plc, The Maltings, West Street, Bourne, Lincs., PE10 9PH, manage your subscription on our behalf and ensure that all personal information supplied is held securely in accordance with the Data Protection Act 1998. When you take out Membership, we need to know your name, address, email address, telephone number and payment card details. Any payment made online will be processed by secure server software.

The Company aims to ensure that viruses (or other programs having adverse effects) do not reside on the Website, but the Company accepts no responsibility in relation to this.

The Website contains a link to PROSPEROstore which in turn has links to suppliers’websites. The Company cannot be responsible for the privacy practices of other such sites.
